It is spring 2026, and the pattern is repeating itself. A new SARS-CoV-2 variant informally named “Cicada” (BA.3.2) is now detected in at least 31 U.S. states[1]. China and Hong Kong are simultaneously reporting their sharpest case rise “in at least a year”, driven by NB.1.8.1[2]. The WHO notes that “limited surveillance data” are increasingly hampering vaccination strategies worldwide[3].
The coverage follows a familiar arc: variant named, geographical spread described, concern voiced, new boosters recommended. What does not appear in this coverage: the fact that, in parallel, the German Federal Court of Justice (BGH) ruling of 9 March 2026 dismantled the dismissal architecture of vaccine-injury proceedings, that the Drosten Enquete is sitting in the Bundestag, and that a Bayer board member said publicly in 2021 that an honestly communicated gene therapy would have met with 95 % refusal.
That isn’t accidental. That is frame work.
The status quo of variant spread #
BA.3.2 / “Cicada” is a sub-lineage recombined from older Omicron branches. U.S. media reported on 16 April 2026 that it is now documented in 31 states and is, as far as patchy sequencing can show, accelerating[1]. CDC variant-tracker data has been visibly thinned out since 2023[4].
NB.1.8.1 is driving the wave in mainland China and Hong Kong. CBS News describes the “worst surge in at least a year”[2]. Here too: official Chinese data is opaque, the wave was not openly communicated for a long time.
The overarching problem was named by Nature on 4 November 2025: global SARS-CoV-2 surveillance has been heavily wound down since the end of the public emergency. Nature’s wording: “limited surveillance data are hampering vaccination strategies”[3]. Translated: nobody really knows what is circulating any more. And on that basis, vaccination recommendations are — again — about to be issued.
What the German federal system has long known #
While the variant maps are being recoloured, the reckoning with what happened between 2020 and 2023 is taking place in Karlsruhe and Berlin. This reckoning is not speculative — it is happening in the highest court and in parliamentary enquete commissions.
Federal Court of Justice, 9 March 2026. The BGH revised, on key points, the burden-of-proof architecture under which lower courts had been dismissing nearly every vaccine-injury suit. More than 400 previously dismissed cases are effectively now eligible for re-examination[5].
Enquete Commission on the reckoning with the corona pandemic. The Bundestag has set up its own commission examining, among other things, the redactions in the RKI files, the role of the then RKI leadership, and the statements of Christian Drosten[6]. The “Drosten Enquete” is not alternative reporting — it is an official Bundestag process.
Health-insurance funds suing the state. Several statutory health-insurance funds have prepared a billion-euro suit against the Federal Republic, on the grounds that the state caused treatment-related downstream costs that it must bear[7]. Health-insurance funds do not file billion-euro suits without a paper trail.
Anyone aware of these three proceedings simultaneously can no longer read a 2026 variant map the way one read a 2021 variant map. It is a different data space.
What the corporations have long said #
It is not the case that industry is silent. It has spoken — but in self-understanding mode, not in reckoning mode.
Stefan Oelrich, Bayer’s pharma board member, said on 24 October 2021 from the stage of the World Health Summit in Berlin, in the presence of WHO leadership and the EU Commission president, in substance: had the public been asked two years earlier whether they would let themselves be injected with a gene or cell therapy, there would have been 95 % refusal. The mRNA vaccines, he said, are an example of exactly that category[8].
Pfizer contracts and Pfizer SMS. The General Court of the EU ruled in 2024 that the EU Commission redacted the vaccine contracts unlawfully. The text messages between Ursula von der Leyen and Pfizer CEO Albert Bourla have to this day not been released[9].
Comirnaty / SV40 DNA. Officially confirmed: Comirnaty batches contained DNA contaminations above the originally stated specification, including sequences from the SV40 promoter[10]. This too is not an alternative-media footnote — it is a regulatory finding.
Batch variability. Research into the Comirnaty approval documentation shows that the EMA accepted an unusually wide range for the active-substance specification[11]. That range explains why studies on differing batch-dependent adverse-event clusters show a consistent signal.
These four points are not “still to be checked”. They are documented. They simply do not appear in variant-wave coverage.
The frame problem: “small minority harmed” #
The BBC published a piece on 17 April 2026 on the COVID vaccination balance sheet, with the tenor: the vaccinations saved many lives, a “small minority” was harmed and needs “better support”[12]. The linguistic architecture of this frame is worth unpacking.
- “small minority” quantifies nothing. It suggests: small group, individual exceptions.
- “harmed” is passive. Who harmed? The frame does not answer.
- “need better support” shifts the topic to social benefits — away from liability, away from criminal law, away from reckoning.
What stands against this frame is hard and court-tested:
- More than 400 BGH-recognised individual cases that the Federal Court ruling of 9 March 2026 has put back on the table[5].
- A health-insurance billion-euro suit that only makes sense if the downstream costs are measurable and systematic[7].
- An enquete commission asking precisely the question that “small minority” frames away: what did authorities know when, and why was it redacted[6]?
The gap between BBC frame and the German evidentiary record is not a matter of opinion. It is measurable.
What to expect by summer 2026 #
Three axes along which the discourse will move in the coming months:
- BGH follow-up rulings. After the 9 March 2026 turning-point, lower courts will have to adjust their burden-of-proof practice. Several pending cases will be remitted or re-decided.
- Enquete interim report. The commission will likely publish an interim status on the redaction practice and on the role of scientific policy advice.
- Variant communication. If new boosters are once again recommended in parallel with BA.3.2 / NB.1.8.1, the central question will be whether recommendation bodies engage at all with the findings documented above — or whether recommendations will once again be issued in “we already know” mode.
The next few months are not an epidemiological test. They are an institutional one.
Conclusion #
BA.3.2 “Cicada” is new. The unanswered questions sitting in parallel are not. Anyone who in 2026 still reports as if variant spread were the only topic, and the reckoning with the vaccine wave a fringe issue of “small minorities”, is actively choosing against the available data space.
The sources are there. The rulings are there. The commissions are sitting. The redactions are documented. What is missing is not the material — it is the willingness to see both at the same time.
