Background#

LLMs like GPT-4 are publicly marketed as “artificial intelligence.” But they understand nothing, do not think, and have no intentions. They generate word sequences based on statistical prediction, not reasoning.

This is not just ethically questionable – it violates EU transparency and consumer protection laws.

Goals of the Lawsuit#

  • Ban the use of “AI” for statistical text generators
  • Mandatory labeling of AI-generated content
  • Legal action against misleading marketing
  • Enforce GDPR and EU AI Act to prevent black-box deception
  • GDPR Articles 5 & 6 – Transparency & Lawfulness
  • German UWG §5 – Misleading commercial practices
  • EU AI Act – High-risk classification due to deception potential

Evidence & Witnesses#

  • Experts: Gebru, Bender, Whittaker
  • ChatGPT itself (as a “self-incriminating witness”)
  • Transcripts and screenshots

Status#
